1. Eligibility and Access
To use Funzo, you must be at least 18 years old. If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian. By using the Platform, you represent and warrant that you possess the legal consent of a parent or guardian.
We reserve the right to refuse service, terminate accounts, or limit access to the Services at our sole discretion if we discover that you are under the required age.
2. Your Account
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process.
Security: You are responsible for safeguarding your password and account details. You agree that you are solely responsible for any activity that occurs under your account.
Termination: If you wish to delete your account, you can do so through the settings in the Funzo app. Once deleted, data cannot be recovered.
3. Acceptable Use
Your access to and use of the Services is subject to these Terms and all applicable Indian laws. You agree NOT to upload, post, or transmit any content that:
• Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order.
• Is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable.
• Encourages money laundering or gambling.
• Harm minors in any way.
• Infringes any patent, trademark, copyright, or other proprietary rights.
• Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact.
• Contains software viruses or any other computer code designed to interrupt, destroy or limit the functionality of any computer resource.
4. Intellectual Property & User Content
Funzo Content: All rights, title, and interest in and to the Services (excluding User Content) are and will remain the exclusive property of Funzo and its licensors.
User Content: You retain your rights to any content you submit, post or display on or through the Services. However, by submitting content, you grant Funzo a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods.
You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any content that you submit.
5. Virtual Items and Payments
You may purchase virtual items (e.g., Coins, Gold) using authorized payment methods (UPI, Google Play, Apple App Store).
• Virtual items are non-transferable and have no monetary value outside of the Funzo Platform.
• Refunds: All purchases are final and non-refundable, except as required by applicable law. We do not process refunds for virtual items once they have been used.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Funzo shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties;
• Unauthorized access, use or alteration of your transmissions or content.
7. Indemnity
You agree to defend, indemnify, and hold harmless Funzo, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, including any question regarding existence, validity or termination of these Terms, shall be subject to the exclusive jurisdiction of the courts located in [Insert City, e.g., Jaipur/New Delhi], India.
